Acceptable Use Policy

The purpose of this policy is to enhance the quality of the Services and to protect ihostFX and customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities. This Policy applies to each Customer and its employees, agents, contractors or other users of such Customer who obtain Services from ihostFX (each such person being a "User"). Each User should use common sense and good judgment in connection with the Services. Parents or guardians should always supervise minors in using the Internet. Parents and guardians should remain aware at all times of what is on the Internet and how the minors under their care are using the Services and the Internet.

Spam

Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of usenet groups, posting obscene or threatening messages while using or referring to an ihostFX email address or website URL is prohibited. The use of ihostFX servers as a mail drop for responses to activities described above is also prohibited.

Cancellation

ihostFX reserves the right to cancel service of an account at anytime without notice and without a refund. An account can be cancelled voluntarily at anytime by contacting our support department. The contents of a cancelled website may be deleted at anytime subsequent to account termination.

30 day "feel safe" guarantee

ihostFX includes a 30 day "feel safe" guarantee on all shared web hosting accounts. This guarantee is offered to ihostFX customers as a protective measure for our new customers. This guarantee covers service defects only, meaning you will receive the services being offered or we will gladly give your money back. The 30 day "feel safe" guarantee is not valid due to buyers remorse, any situation that may occur beyond our control, failure to understand our services and features, or for any other reasons.

Refunds

Hosting prepayments, setup fees and add-on fees are nonrefundable. You must request cancellation prior to your next billing cycle beginning to prevent charges from being assessed.

Security

Attempts to manipulate ihostFX servers or client websites are prohibited. This includes, but is not limited to, attempting to gain unauthorized access to ihostFX servers, mail bombing, or other means of deliberately overloading systems.

Network/System Abuse

This includes, but is not limited to, excessive use of CPU resources, disk space or network bandwidth, installing IRC bots, CGI scripts sharing with domains outside of ihostFX, mass emails, using disproportionate amounts of system resources for CGI Scripts or any manner of monopolization of network resources. ihostFX will determine what constitutes system abuse.

Software/Multimedia Distribution

Accounts can not be used to distribute copyrighted software, "cracked" versions of copyrighted software (a.k.a. warez), serial numbers for copyrighted software or copyrighted multimedia files (i.e. music files or video). Sites that contain links to pirated software or illegal contraband are also prohibited.

Policy Violation

If an account is used unlawfully, or is in violation of the user policy, ihostFX reserves the right to terminate the account without notice and without refunds. Files that violate the user policy are subject to deletion without notice. Clients violating the User Policy may be held responsible for damages to ihostFX, including but not limited to, ihostFX servers, connectivity, reputation, business, service, network, operations or equipment. Determining what constitutes a policy violation is the sole discretion of ihostFX.

Website Content Management

ihostFX is not responsible for website management or files lost or damaged by users. Website construction and management is the responsibility of the client. Client-maintained backup of all site files is recommended and should be maintained outside of ihostFX facilities. System backups are intended to be used in the event of system failures and are not intended to be accessed to restore files to individual sites.

Adult Content

Sites containing adult material are not allowed on our UNIX Based Servers at ihostFX. The final determination on what constitutes "adult content" and whether it is acceptable will be made by ihostFX.

Log Files

Log files may be deleted on a periodic basis. Users are responsible for downloading their log files. It is recommended that clients who wish to maintain a history of their log files download them monthly.

Indemnification/Disclaimer

ihostFX does not guarantee that our services will be uninterrupted or error free and will not be held liable for any claims resulting from the use or the inability to use ihostFX services including, but not limited to, service interruptions, Internet connectivity problems, unauthorized access to ihostFX, domain name registrar problems, DNS caching, Internet bandwidth congestion, power failures and natural disasters. ihostFX services are sold AS-IS. By using ihostFX, the client agrees to indemnify and hold ihostFX harmless against any liabilities arising out of defective products sold to customers from ihostFX servers, personal injury or property damage caused by products or services sold or distributed from ihostFX servers, any material that infringes or allegedly infringes on the rights of a third party available from ihostFX servers, and any material that libels or allegedly libels a third party available from ihostFX servers.
